The Committee on Energy and Manufacturing moved to amend the bill on page 2, section 8, beginning on line 20, by striking subsection (c) in its entirety and inserting a new subsection (c) to read as follows:

 

(c) In addition to the requirements of subsection (b), memoranda of leases and amendments thereto which may burden a severed mineral estate shall include identification of the most recent tax map and parcel numbers of the overlying surface parcels as set forth in the underlying lease, if applicable, or if the map and parcel numbers are not set forth in the underlying lease, based on a reasonable review of publicly available surface estate tax maps maintained by the county or counties; a general statement that the mineral owners and lessees may have rights which burden the overlying surface arising out of a severance instrument or law; and notwithstanding any other provision of this code to the contrary, when presented to the clerk or clerks of the county commission in which the property is located, the clerk shall index the instrument in the public record under the names of the surface owner or owners as identified on the most recent tax tickets for the overlying surface estates.
